8HP Tuner is operated by Shafield Pty Ltd (ABN 54 696 523 976), a company registered in Queensland, Australia, trading as 8HP Tuner. References to "we", "us", or "our" refer to Shafield Pty Ltd.
By creating an account, purchasing a licence, or using the 8HP Tuner application ("the App"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the App.
These terms apply to all users including free trial users, Single ECU licence holders, Tuner Pro subscribers, and sub-users created under a master account.
8HP Tuner is an AI-assisted analysis and guidance tool for tuning ZF 8HP automatic transmissions (Generation 1: 8HP45, 8HP70, 8HP90) via MaxxECU MTune software. The App:
8HP Tuner is an independent tool and is not affiliated with, endorsed by, sponsored by, or associated with MaxxECU AB, Turbolamik, ZF Friedrichshafen AG, or any vehicle manufacturer, ECU manufacturer, or transmission supplier. All product names, trademarks, and brand names referenced within the App are the property of their respective owners and are used solely for identification and compatibility purposes.
All outputs from 8HP Tuner, including recommendations, table values, suggested parameter changes, and diagnostic flags, are AI-generated guidance only. They do not constitute professional engineering advice, mechanical advice, or advice from a qualified automotive tuner.
You must:
Vehicle tuning involves inherent mechanical and safety risks. Incorrect changes to transmission settings can result in transmission damage, loss of vehicle control, personal injury, property damage, or death. By using this App you acknowledge these risks and agree that you are solely responsible for the consequences of any changes made to any vehicle.
Access to full App features requires a paid licence (Single ECU or Tuner Pro). Licences are tied to the email address used at purchase and are non-transferable. You are responsible for maintaining the security of your account password and for all activity under your account.
Sub-user accounts may be created under a Tuner Pro master account. The master account holder is responsible for ensuring all sub-users are informed of and agree to these Terms before accessing the platform.

All content, AI systems, diagnostic logic, system prompts, and software within the App are the intellectual property of Shafield Pty Ltd and are protected by Australian and international copyright law. You may not reproduce, distribute, or create derivative works from any part of the App without written permission.
You retain ownership of any tune files or logs you upload. By uploading, you grant us a limited licence to process that data solely for the purpose of providing the service to you.
To the maximum extent permitted by law, Shafield Pty Ltd, its directors, employees, and agents are not liable for any loss, damage, or injury — including engine or transmission damage, vehicle loss, financial loss, loss of data, or personal injury — arising from your use of or reliance on the App or its outputs.
Nothing in these Terms excludes any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). Where consumer guarantees apply, our liability is limited to re-supplying the service or paying the cost of having it re-supplied.
We aim to maintain consistent service availability but do not guarantee uninterrupted access. We may suspend the service temporarily for maintenance, updates, or reasons outside our control. Credits will not be consumed during periods of confirmed service outage.
We may update these Terms from time to time. Continued use of the App after notice of changes constitutes acceptance of the updated Terms. Significant changes will be notified via the App or by email.
These Terms are governed by the laws of Queensland, Australia. Any disputes are subject to the non-exclusive jurisdiction of the courts of Queensland.

We do not use your data for advertising purposes. We do not sell, rent, or share your personal information with third parties for their own marketing.
When you send a message in the App, your message and relevant context (tune file data, vehicle information, session history) are transmitted to Anthropic, Inc. for AI processing via their API. This means your tuning data and questions are processed on Anthropic's infrastructure in accordance with their Privacy Policy and Usage Policy.
We do not transmit your email address or account credentials to Anthropic. Tune file data is transmitted without the ECU serial number where technically possible.

The 8HP Tuner app does not use advertising cookies or tracking pixels. We use browser localStorage and sessionStorage solely for session management and to persist your app state between page loads. No third-party tracking scripts are loaded on the app domain.
The landing page (8hptuner.com) is served via Cloudflare Pages which may set technical cookies necessary for security and performance. No analytics tracking (e.g. Google Analytics) is currently deployed.
8HP Tuner is intended for adults 18 years and older. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will delete it promptly.
We may update this Privacy Policy from time to time. Significant changes will be communicated via the App. Continued use of the App after changes constitutes acceptance of the updated Policy.

All purchases of 8HP Tuner licences and credit top-ups are generally non-refundable once credits have been used or once the subscription period has begun, except as required by the Australian Consumer Law or as described below.
Service failure: If the 8HP Tuner service fails to function as described — for example, if the AI consistently fails to process your files, if the app is unavailable for an extended period, or if credits are deducted without a response being delivered — you are entitled to a remedy. Contact us within 14 days of the issue and we will:
Accidental duplicate purchase: If you accidentally purchase the same product twice within a 24-hour window, contact us at support@8hptuner.com within 48 hours. We will review the usage records and refund the duplicate charge if no credits from the duplicate order have been used.
Tuner Pro — subscription cancellation: Tuner Pro is an annual subscription. If you cancel your subscription, access continues until the end of the billing period. We do not issue pro-rata refunds for unused subscription time unless the service has materially failed to deliver what was promised.
Nothing in this Refund Policy limits, excludes, or modifies any rights you have under the Australian Consumer Law (ACL) that cannot be excluded. Under the ACL, you may be entitled to a remedy if a service has a major failure. Where a statutory guarantee applies and the failure is major, you are entitled to choose a refund or other remedy. Where the failure is minor, we may choose to repair or re-supply the service.
